Once again, our customised Workflow software ensure that recovery claims and actions are processed quickly and efficiently. We are responsible for several leading Judgments in relation to this area. For example, we acted on behalf of the employer in Nominal Defendant v Hi-Light Industries Pty Limited [2004] NSW CA 423, a case which went all the way to the High Court, resulting in the right of employers to seek Section 151Z recoveries from the Nominal Defendant being confirmed. As a consequence, employers continue to recover millions of dollars annually from the Nominal Defendant in cases where compensation has been paid as the result of the negligence of unidentified or unregistered motor vehicles.

OH&S Consulting

New South Wales employers recognise that with the high premium impact of insurance claims, there is a strong commercial imperative to concentrate on risk minimisation.

We offer advice in relation to OH&S obligations and risks and we are able to arrange for legally privileged expert OH&S analysis and recommendations of all workplaces.

There can be no doubt that this type of upfront expenditure is an investment that can be recouped severalfold through savings on insurance premiums, business interruption, recruitment and retraining costs etc through risk management.

WorkCover Prosecutions

Corporations and their Directors and Managers and individuals are liable for prosecution by WorkCover for breaches of the Occupational Health & Safety Act 2000. Breaches of the Act can result in criminal conviction and the imposition of substantial fines.

Our Senior Lawyers are experienced in acting in the defence of WorkCover prosecutions. We will critically assess the allegations and the claim and, if necessary, arrange for expert evidence to be obtained. We will advise you of the prospects and likely costs of successfully defending the charge, compared to the benefits and likely outcome in the event of a plea.
