We have an outstanding record of success acting on behalf of the New South Wales Insurance industry for 27 years, and we have been responsible for many of the landmark Judgments and Decisions which presently govern the law and procedure in relation to litigated claims.
Our Partners and Special Counsel are recognised as industry leaders in the field of insurance litigation.
We value our long relationships with leading insurers by virtue of both Panel representation and appointment by major employer organisations as preferred legal provider.
Claims & Litigation Support
Our experienced management team and our dedicated and highly trained lawyers and staff are committed to providing the highest quality in all aspects of our operations, ensuring that Edwards Michael Powell Lawyers is the benchmark legal practice for the future.
Proprietary Workflow software enables us to complete Key Dates and Tasks on time, every time, and to guarantee that our client’s expectations will be exceeded.
Our focus is on accessibility, accuracy, effective advice and communication, costs containment, and driving for excellent outcomes.
We have a proven record of industry leading performance in relation to all aspects of insurance litigation. Our Senior Lawyers are all highly experienced in relation to these claims and the firm has appeared in many of the Supreme Court and Court of Appeal leading decisions in relation to this area.
We are proud of the skills and the record of success of our Recoveries team. Once again, our customised Workflow software ensure that recovery claims and actions are processed quickly and efficiently. We are responsible for several leading Judgments in relation to this area. For example, we acted on behalf of the employer in Nominal Defendant v Hi-Light Industries Pty Limited NSW CA 423, a case which went all the way to the High Court, resulting in the right of employers to seek Section 151Z recoveries from the Nominal Defendant being confirmed. As a consequence, employers continue to recover millions of dollars annually from the Nominal Defendant in cases where compensation has been paid as the result of the negligence of unidentified or unregistered motor vehicles.
Education & Training
The Senior Lawyers from Edwards Michael Powell regularly deliver training sessions and seminars, for insurance clients and externally, and attend upon insurers for in-house consultation and training.
Our Senior Lawyers are also published authors in relation to new developments and issues affecting the insurance industry.
We publish a quarterly newsletter, reporting on recent decisions and issues.
We also provide an annually reviewed Costs Guidebook, including historical information on applicable rates for costs, IME rates, interpreters’ fees, country loadings, motor vehicle allowances etc.
New South Wales employers recognise that with the high premium impact of insurance claims, there is a strong commercial imperative to concentrate on risk minimisation.
We offer advice in relation to OH&S obligations and risks and we are able to arrange for legally privileged expert OH&S analysis and recommendations of all workplaces.
There can be no doubt that this type of upfront expenditure is an investment that can be recouped severalfold through savings on insurance premiums, business interruption, recruitment and retraining costs etc through risk management.
Corporations and their Directors and Managers and individuals are liable for prosecution by WorkCover for breaches of the Occupational Health & Safety Act 2000. Breaches of the Act can result in criminal conviction and the imposition of substantial fines.
Our Senior Lawyers are experienced in acting in the defence of WorkCover prosecutions. We will critically assess the allegations and the claim and, if necessary, arrange for expert evidence to be obtained. We will advise you of the prospects and likely costs of successfully defending the charge, compared to the benefits and likely outcome in the event of a plea.
We will attend to all evidentiary issues and advocacy in order to ensure the best possible outcome.
